1. Introduction

By accessing or using C.K. NEXUS IT SOLUTIONS (“we,” “our,” “us”) website and technology services (“Service”), users (“User,” “they,” “their”) agree to comply with and be bound by the following terms and conditions (“Terms”). Users should read Terms carefully before using Service. If users do not agree to Terms, users should not use Service.

Where a User uses Service on behalf of a business or other legal entity, the User confirms authority to bind that entity to Terms, and that entity will be responsible for compliance.

Terms apply to both individuals and businesses. For purposes of Terms:

  • “Consumer” means a natural person acting for purposes outside their trade, business, craft, or profession.
  • “Business User” means any User that is not a Consumer.

Nothing in Terms limits any rights that cannot be excluded under applicable Cyprus law, including mandatory consumer rights where applicable.

  • Billing Cycle: charges for the selected subscription plan will be billed in advance based on the billing cycle (monthly, quarterly, semi-annually, or annually).
  • Payment Methods: we accept various payment methods, including credit cards, debit cards, and electronic transfers. Payment details must be provided at the time of subscription or as otherwise agreed.

  • Consumers (right of withdrawal for distance sales): where applicable law provides a right of withdrawal for Consumers who purchase at a distance, Consumers may have a legal right to withdraw within 14 days of contract conclusion, subject to applicable exceptions and conditions.
  • Where a Consumer requests that we begin providing services during the withdrawal period and later withdraws, the Consumer may be required to pay an amount proportionate to services provided up to the time the Consumer informed us of withdrawal, where permitted by law.
  • Where a service is fully performed within the withdrawal period, the right of withdrawal may be lost only where performance began with the Consumer’s prior express consent and the Consumer acknowledged that the right of withdrawal would be lost once the service was fully performed, to the extent applicable.
  • To exercise a right of withdrawal, Consumers should email dpo@nexusitsolutions.com.cy with a clear statement of withdrawal and sufficient details to identify the account/order (for example name, email used, and invoice/order reference).
  • Termination by Us: we may suspend or terminate a User’s access to Service in cases of non-payment, violation of Terms, or other lawful reasons. Where we determine it is necessary to terminate for reasons unrelated to the User’s conduct or violation of Terms, a prorated refund will be provided for any unused portion of a prepaid subscription.

If any inconsistency exists between Terms and Hosting Terms and Conditions, Hosting Terms and Conditions prevail for hosting services.

10. Third-Party Services

Some Services may rely on third-party platforms, tools, or providers (for example cloud services, telecommunications providers, or software vendors). Where third-party services are involved:

  • third-party terms may apply, and Users are responsible for complying with them; and
  • we are not responsible for third-party failures, outages, policy changes, or suspensions resulting from a User’s breach of third-party terms.

11. Limitation of Liability

  • Liability: to the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from a User’s use of Service, including data loss, service interruption, or loss of business.
  • Consumers: nothing in Terms limits or excludes liability where such limitation or exclusion is not permitted under applicable law (including mandatory consumer rights).
  • Non-excludable liability: nothing in Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Privacy

  • Data Collection: we collect and use personal information in accordance with the Privacy Policy: https://www.nexusitsolutions.com.cy/privacy-policy/

We may revise Terms from time to time to reflect updates to services, legal requirements, or business operations. In the event of material changes that significantly affect Users’ rights or obligations, Users will be duly notified via email or via a prominent notice on the website prior to the changes taking effect. Continued use of Service after the effective date of updated Terms will constitute acceptance of those changes. If Users do not agree to revised Terms, Users must discontinue use of Service before the effective date.

14. Governing Law

Terms shall be governed by and construed in accordance with the laws of Cyprus.

Business Users: any disputes arising under or in connection with Terms shall be subject to the exclusive jurisdiction of the courts in Cyprus.

Consumers: where a Consumer is habitually resident in the EU/EEA, mandatory consumer protection and jurisdiction rules may allow proceedings to be brought in the courts of the Consumer’s place of residence and may restrict where proceedings may be brought against the Consumer. Nothing in this clause limits those mandatory rights.
